Trump seeks pause of federal election trial to challenge immunity ruling

by

President Donald Trump’s legal team on Monday requested a pause of a federal election trial in Pennsylvania to take up an emergency appeal of a judge’s ruling that denied the president immunity from a defamation lawsuit filed by an adult film actress. Trump’s lawyers argued in a filing with the 3rd U.S. Circuit Court of Appeals in Philadelphia that the district judge’s ruling should be reversed or at least frozen for the duration of the trial, which is scheduled to begin on Tuesday in the “Stormy Daniels” case filed by the actress, who claims Trump defamed her in a tweet. In a motion seeking an immediate stay, the Trump team claimed it had “a strong likelihood of success” on appeal because the judge had no authority to hear the case due to the president’s immunity from lawsuits while he is in office.
